Terms & Conditions

Last updated: 2026

These terms govern the relationship between you (the entrant), the sponsoring organization, and the sweepstakes you are entering. HOP provides the software platform and is not a sponsor or party to any individual fundraiser.

Important — Please read. HOP GiveAway is a technology service operated by Hop Giveaway LLC ("HOP"). HOP is not a law firm and does not provide legal, tax, or compliance advice. HOP does not warrant that any fundraiser, sweepstakes, raffle, or promotion run using the platform is lawful in any particular state or jurisdiction. Each organization is solely responsible for ensuring its fundraiser complies with all applicable federal, state, and local laws. By using HOP GiveAway, you accept full responsibility for legal compliance and you agree that Hop Giveaway LLC shall not be held liable for any aspect of your fundraiser.

1. The Service

HOP GiveAway (the "Platform," "we," "us") provides software tools that help organizations create and run online charitable fundraising sweepstakes, including auto-generated official rules templates, payment processing facilitation, and supporter communication tools. The Platform is operated by Hop Giveaway LLC.

The Platform is a service provider only. We are not the sponsor, operator, or administrator of any individual fundraiser created by an organization, and we do not control how organizations conduct their fundraisers.

2. No Legal Advice

Nothing provided by Hop Giveaway LLC or the Platform — including auto-generated official rules, free-entry (AMOE) forms, templates, help articles, or any other materials — constitutes legal, tax, accounting, or compliance advice, and none of it should be relied upon as such. All such materials are provided "AS IS," for convenience only, and may not be appropriate or sufficient for your specific circumstances or jurisdiction. You should consult your own licensed attorney regarding the legality of your fundraiser before launching it.

3. Organization Responsibility for Compliance

The organization running a fundraiser (the "Sponsor") is solely and exclusively responsible for the legality, registration, bonding, operation, administration, tax reporting, and prize fulfillment of its fundraiser, and for compliance with all applicable laws in every state and jurisdiction in which it operates or accepts entries. This includes determining whether a license, permit, or registration is required and obtaining it. HOP GiveAway makes no representation that any fundraiser is permitted in any jurisdiction.

4. Eligibility & State Restrictions

Sweepstakes laws vary by state and change over time. Sweepstakes are open to eligible U.S. and District of Columbia residents except Washington. Washington residents cannot enter or win by purchase or mail-in AMOE. Sweepstakes are void where prohibited or restricted by law. Entrants and Sponsors are each responsible for confirming that participation is legal where they reside or operate. See the Official Rules for full eligibility details.

5. Disclaimer of Warranties

The platform and all materials are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranty that the platform or any fundraiser is lawful, error-free, or compliant with the laws of any jurisdiction.

6. Limitation of Liability

To the maximum extent permitted by law, in no event shall Hop Giveaway LLC, HOP GiveAway, or their parent, affiliates, officers, directors, employees, agents, or assigns (collectively, the "Released Parties") be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or relating to the platform, any fundraiser, any sweepstakes, any prize, or any legal or regulatory action, whether based in contract, tort, statute, or otherwise, even if advised of the possibility of such damages.

To the maximum extent permitted by law, the released parties' total aggregate liability for any and all claims relating to the platform shall not exceed the total platform fees actually paid to HOP in connection with the specific fundraiser giving rise to the claim.

7. Release

By using the Platform, entering any fundraiser, or accepting any prize, you irrevocably release and forever discharge the Released Parties from and against any and all claims, demands, liabilities, damages, losses, costs, and expenses (including attorneys' fees) of any kind, known or unknown, arising out of or relating to the Platform, any fundraiser, the administration of any fundraiser, or the acceptance, use, or misuse of any prize.

8. Indemnification

The Sponsor agrees to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, liabilities, damages, losses, judgments, fines, penalties, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to the Sponsor's fundraiser, the Sponsor's use of the Platform, or the Sponsor's violation of any law, regulation, or third-party right. Hop Giveaway LLC shall not be named in, or held liable for, any regulatory, civil, or criminal action arising from a Sponsor's fundraiser.

9. Governing Law & Severability

These Terms are governed by the laws of the State of Oklahoma, without regard to conflict-of-laws principles. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
